Please read these terms carefully before using Spark. By accessing or using the platform you agree to be bound by them.

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Spark Dating App ("Spark," "we," "us," or "our") governing your use of the Spark mobile and web application, including all content, features, and services offered through smartsparks.app (collectively, the "Platform").
By creating an account, accessing, or using the Platform, you affirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Platform.
You must be at least 18 years of age to create an account or use the Platform. By using Spark you represent and warrant that you are 18 or older. We do not knowingly allow minors to use the Platform. If we learn that a user is under 18, we will immediately terminate their account.
You must not be prohibited from using the Platform under applicable law or under any previous suspension or ban imposed by Spark.
To use most features of the Platform you must register an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You may not create accounts using automated means, create multiple accounts, or create an account on behalf of another person without their explicit consent.
You agree to use the Platform only for lawful purposes and in a way that does not infringe the rights of others or restrict or inhibit their use and enjoyment. Prohibited conduct includes but is not limited to:
Violation of this section may result in immediate account termination and referral to law enforcement where appropriate.
Spark has a zero-tolerance policy for human trafficking, sexual exploitation, and any related conduct. Violations result in immediate permanent account termination and mandatory reporting to law enforcement.
The following conduct is absolutely prohibited and constitutes a material breach of these Terms:
We actively monitor the Platform for signs of trafficking and exploitation and cooperate fully with law enforcement investigations. If you encounter suspicious activity, please report it immediately to [email protected] or the National Human Trafficking Hotline at 1-888-373-7888.
The Platform and all content created by Spark — including but not limited to text, graphics, logos, icons, images, and software — are the exclusive property of Spark Dating App and are protected by applicable intellectual property laws.
By uploading photos or other content to the Platform, you grant Spark a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely for the purpose of operating and improving the Platform. You retain ownership of your content.
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SPARK DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Spark does not conduct criminal background checks on users. You are solely responsible for your interactions with other users. Exercise caution when meeting anyone in person.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPARK AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF SPARK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO SPARK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
We may suspend or terminate your account at any time, with or without notice, for any reason including but not limited to a breach of these Terms. Upon termination, your right to use the Platform ceases immediately.
You may delete your account at any time through the Platform settings. Account deletion is subject to our data retention practices described in the Privacy Policy.
These Terms are governed by and construed in accordance with the laws of the United States. Any dispute arising out of or related to these Terms or the Platform shall first be addressed through good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration.
We may update these Terms from time to time. We will notify you of material changes via in-app notification or email. Continued use of the Platform after the effective date of updated Terms constitutes your acceptance of the changes. The current version is always available at smartsparks.app/terms.html.
